Terms & Conditions
These Terms and Conditions (“Terms and Conditions”) of the Registered Customer Account explain the nature and scope of the Programme and govern the participation of a registered customer (“Registered Customer” or “you”). By using the Programme, the Registered Customer represents and warrants that he/she has full legal capacity, competency, and authority to agree and bind himself / herself to these Terms and Conditions. The Terms and Conditions are subject to change, without any prior intimation and subject to the sole discretion of Air India from time to time. Any additional terms and conditions as provided on the website - www.airindia.com shall be applicable to the Registered Customer in addition to these Terms and Conditions.
1.1 By registering and creating a Registered Customer Account via the Air India website or the Air India mobile app, you may access various travel related services and website and mobile app functionalities (“Services”) that are offered by Air India (“our”, “us” or “we”), marketing communication preferences and profile management services.
1.2 By completing the online registration process to become a Registered Customer, you hereby agree to these Terms and Conditions which set out and define the contractual relationship between Air India and each Registered Customer. All persons applying to become a Registered Customer shall be deemed to have read and accepted the Terms and Conditions. Registered Customers are responsible for keeping themselves informed of the current Terms and Conditions which are posted on www.airindia.com. Continued participation in the Programme will be regarded as acceptance of the current Terms and Conditions.
1.3 Definitions: Unless the context otherwise requires:
a) “Air India” means Air India Limited, having its registered office at Block 4, Vatika One on One, Sector 16, NH 48, Gurugram-122007, Haryana.
b) “Air India Group” means Air India Limited and Air India Express Limited.
c) “Maharaja Club” means the Air India’s frequent flyer programme under the name “Maharaja Club”.
d) “Personal Data” means any information about an individual that can be used to identify them – for instance, name, contact information, preferences, etc.
e) “Processing” and “Processed” refers to the obtaining, using, recording, altering, sharing, storing or deleting data in electronic or physical form.
f) “Programme” means Air India’s Registered Customer programme.
g) “Registered Customer Account” means the individual membership account created under Air India’s Registered Customer programme. This account is used to access various Services that are offered by Air India.
1.4 Air India reserves the right to terminate the Programme or any part thereof, at any time and regardless of notice.
1.5 Although Air India will use reasonable efforts to notify Registered Customers of material changes to the Programme and/or to these Terms and Conditions, it is the responsibility of the Registered Customers to keep themselves up to date. Any continued use of Registered Customer Account will be deemed as acceptance of any amendment.
1.6 Air India shall not be liable for any loss or damage, whether direct or indirect, resulting from the termination or change of the terms and conditions of the Programme or any of the Services, benefits, facilities or arrangements which are available to Registered Customers pursuant to the Programme (including without limitation, the withdrawal of or limitation of any of the Services, benefits, facilities or arrangements which are available to Registered Customers pursuant to the Programme).
1.7 Air India will endeavour to ensure the availability of Services and benefits under the Programme. Save to the extent expressly permitted by applicable Indian law, Air India will not be liable for loss or damage of any kind, including any special, indirect, consequential, punitive or exemplary damages or any loss of profit or loss of contract, loss of goodwill or reputation, loss of opportunity, loss of revenue or third-party loss whether foreseeable or otherwise whatsoever arising out of or in connection with the Programme or the provision or failure or the refusal to provide any services or benefits under these Terms and Conditions, or from any termination or change in the Programme and their related benefits as mentioned above. Air India shall likewise not be liable for any omissions or errors that may have occurred in the non-communication of information relating to Terms and Conditions, which are available on the website - www.airindia.com
1.8 Air India may assign these Terms and Conditions in favour of any of its subsidiaries, subcontractors or appointed agents without any notice to the Registered Customer, to carry out any of its obligations herein. Air India shall not be responsible to the Registered Customer for any delay in performance or non-performance of the obligations herein by it or its sub-contractors and / or agents due to causes beyond its reasonable control. Registered Customers are responsible for keeping themselves informed of the current Terms and Conditions of the Programme which are posted on the website – www.airindia.com. Participation in the Programme by a Registered Customer will be regarded as acceptance of the current Terms and Conditions.
1.9 Air India reserves the right to interpret, apply and communicate the Terms and Conditions as posted on www.airindia.com. All decisions made by Air India shall be final and conclusive in each case.
1.10 The Terms and Conditions of the Programme control an individual membership and personal individual participation in the Programme and no covenants of law or in equity shall be implied or incorporated.
1.11 Any failure to follow these Terms and Conditions, Air India’s contract of carriage, Air India‘s fare rules, any abuse of the Programme, any violation of law, rule or regulation, any conduct detrimental to the interests of Air India, any fraudulent activity or attempted fraudulent activity, or any misrepresentation of any information furnished to Air India by any Registered Customer, or anyone else acting on the Registered Customer’s behalf, may result in the termination by Air India of the Registered Customer Account of such Registered Customer in addition to the loss or cancellation of the Programme benefits. Such terminated Registered Customers shall not be eligible to participate in any aspect of the Programme and shall not be eligible to enrol with new accounts.
These Terms and Conditions shall be governed by and construed in accordance with the laws of India and the courts of New Delhi shall have exclusive jurisdiction over all issues or disputes arising out of or in relation to these Terms and Conditions.
2.1 A Registered Customer Account may be created by either signing up with the use of a unique and valid email address or mobile number personal to the Registered Customer or by linking the Registered Customer’s applicable social media accounts to the Registered Customer Account.
2.2 Enrolment of several persons in a single account (i.e., a joint account) is not permitted.
2.3. All existing subscribers to the Air India Group marketing communications are permitted to open a Registered Customer Account. If you are an existing subscriber to the Air India Group marketing communications, by opening a Registered Customer Account, you agree and acknowledge that the data stored in relation to your subscription will be transferred to your Registered Customer Account.
2.4 A Registered Customer Account belongs to the specified individual and cannot be transferred to any other individual(s).
2.5 The email address provided by a Registered Customer must be a valid email address which is personal to the Registered Customer.
2.6 Information relating to any third parties should not be submitted without the prior consent from such individuals. By submitting information about any third parties, you represent and warrant that such third parties have consented to the Processing (including but not limited to the collection, use and disclosure) of their Personal Data for the purposes as described in these Terms and Conditions and that such parties agree to these Terms and Conditions.
2.7 It is the responsibility of the Registered Customer to ensure that all information provided for the creation and maintenance of the Registered Customer Account is complete, accurate, and updated.
2.8 It is the responsibility of Registered Customers to keep their email address and mobile number up to date. Any communication sent to a Registered Customer’s unique email address or mobile number will be regarded as delivered when emailed or sent. Air India will not be responsible for any delayed, misdirected or lost email. Registered Customers can update their mobile number and email address online in their Registered Customer profile by contacting the Customer Support Portal for Registered Customers, at any time.
2.9 Profile data including the management of marketing communication preferences, may be accessed or changed either via the dashboard of your Registered Customer Account, or by contacting the Customer Support Portal for Registered Customers.
2.10 Information provided by the Registered Customer at the time of registration or processed through the use of the Registered Customer Account will be shared with the Air India Group.
3.1 Enrolment as a Registered Customer is subject to these Terms and Conditions.
3.2 Enrolment as a Registered Customer may be prohibited or restricted in some countries. Nothing in these Terms and Conditions should be read to override or circumvent any such foreign laws. Any restrictions based on local laws will apply accordingly.
3.3 Only individuals aged 18 years or above can be enrolled as a Registered Customer, except wherever prohibited by law.
3.4 If a minor has created a Registered Customer Account without parental or guardian consent, the parent or guardian should contact either Air India to remove the data and cancel the Registered Customer Account. If Air India becomes aware that a person under the age of 18 has created a Registered Customer Account without parental or guardian consent, Air India will terminate the Registered Customer Account and remove all associated information.
3.5 The Programme is for individual use only, and duplicate accounts with the same details are not permitted.
3.6 Corporations, organizations, and/or other institutions or entities cannot be enrolled as Registered Customers.
3.7 Registered Customers will be accepted at the sole discretion of Air India.
3.8 Registered Customer enrolment benefits are offered at the sole discretion of Air India.
3.9 Eligible individuals can enrol themselves in the Programme by submitting the enrolment form online. An applicant will be regarded as a Registered Customer for the purposes hereof on completion of the formalities of enrolment and subject to terms of the Programme.
3.10 Air India reserves the right to reject any membership application.
3.11 Air India reserves the right to refuse enrolment to any person without assigning any reason; to suspend and/or to terminate the Registered Customer Account of any person for misuse or abuse of the Registered Customer Account or for use not in accordance with these Terms and Conditions or any breach of these Terms and Conditions or for misuse or abuse of Services or benefits.
3.12 Unless it is a sign-in through a social media account, OTP verification on mobile phone number and email) is mandatory to log-in to the Registered Customer Account, . Registered Customers are solely responsible for maintaining the confidentiality of OTP received and shall immediately notify Air India and, in any case, not later than 2 (Two) hours, in the event of unauthorised access to the OTP. Air India is not responsible for any actions or loss arising out of shared OTPs.
3.13 Only the Registered Customer can access their Registered Customer Account for transactions. Delegating access to third parties (e.g., travel agents or assistants) via power of attorney, contract, authority letter or otherwise is not permitted.
3.14 Air India reserves the right to modify the Registered Customer Programme and its benefits and other features, including these Terms and Conditions at any time without prior notice. This includes changes, without limitation, to the following:
- Social media log in mechanisms;
- Website; and
- Mobile app
4.1 Registered Customers can upgrade to a Maharaja Club account. Upon the successful upgrade to a Maharaja Club account, all relevant information collected under the Registered Customer Account will be transferred to the newly registered Maharaja Club account.
4.2 Existing Maharaja Club members are not permitted to sign up for a Registered Customer Account.
5.1 Registered Customers agree to be liable for all transactions made pursuant to the use of the web/mobile app account (including log in details and OTP verification) whether made with or without the Registered Customers’ knowledge or consent. Registered Customers acknowledge that Air India is under no obligation or duty to verify the authenticity of any person who performs transactions after social media sign in or verification of OTP on registered email ID or phone number.
5.2 The Air India Group reserve(s) the right to make promotional offers selectively available to certain Registered Customers at any time, based on flight activity, geographic locations, Programme participation, or other factors that may be determined at the sole discretion of the Air India Group.
5.3 Air India will not be held liable for any loss, damage or expense incurred by the Registered Customer however caused, through any unauthorized disclosure or unauthorized use of their web account (including log in details).
5.4 All communications shall be addressed to the Customer Support Portal for Registered Customers.
5.5 If any provision of these Terms and Conditions is determined by any court or other competent authority to be unlawful or unenforceable, the other provisions of these Terms and Conditions will continue to be in effect. If any unlawful or unenforceable provision would be lawful or enforceable if a part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect (unless that would contradict the clear intention of the clause, in which case the entirety of the relevant provision will be deemed to be deleted). Air India shall not (i) provide any service, or (ii) perform any action, in pursuance of these Terms and Conditions that violates applicable laws.
5.6 You shall not license, sell, transfer, or assign your rights, obligations, or covenants under these Terms and Conditions in any manner without Air India’s prior written consent.
5.7 Air India reserves the right to audit the Registered Customer Accounts at any time to ensure compliance with the Terms and Conditions without prior notice. During audits, Registered Customer Account information may be shared with contracted third parties or Government/legal authorities. If discrepancies or violations are found, Air India may suspend such Registered Customer Accounts without prior notice.
6.1 Registered Customers may provide Personal Data to Air India while receiving the Services under this Programme, including but not limited to, at the time of signing-up for the Programme, updating their information in the “View Profile” section, contacting us for support or making flight bookings.
6.2 By becoming a Registered Customer, the individual acknowledges that their Personal Data may be processed as per the Privacy Notice and the terms mentioned herein.
6.3 If a Registered Customer who has opted in to receive marketing communications, wishes to opt out of marketing communications, they can manage their preferences online under “View Profile” or opt-out using the unsubscribe link provided in marketing emails.
6.4 All data related to a Registered Customer that is held by Air India is considered to be confidential information and will not be released unless it is used for the purposes provided within the Privacy Notice.
7.1 Without prejudice to the foregoing, Air India reserves the right to suspend or delete any Registered Customer Account or any part thereof, at any time with or without prior notice, if such Registered Customer has contravened these Terms and Conditions.
7.2 A Registered Customer may delete the Registered Customer Account at any time by contacting the Data Protection Officer at data.privacy@airindia.com. Deletion of a Registered Customer Account is permanent and cannot be undone.
7.3 A deleted Registered Customer will not be permitted to login to the Air India website or mobile app with the Registered Customer Account.
8.1 Membership enrolment and eligibility, availability of Services and benefits are subject to the Terms and Conditions of the Programme and are subject to any applicable laws and regulations, including applicable IATA regulations.
8.2 Air India may change, add, modify or withdraw the Terms and Conditions at any time without giving notice as well as any benefits provided in connection with the Programme and any special offers or promotional offers made to any Registered Customer.
8.3 These Terms and Conditions are in addition to and not in derogation to the terms and conditions (including Privacy Notice) as specified on Air India’s website - www.airindia.com, which terms and conditions shall also be applicable to the Programme.
9.1 Air India regularly reviews and updates the information on its web pages, Terms and Conditions and other materials, including but not limited to marketing and promotional materials. Despite its best endeavours, it is possible that some of the information is not accurate or could have become outdated. Air India, therefore, does not accept any responsibility or liability for such information, and does not guarantee that the information provided is up-to-date, correct and complete. Apart from this, the Terms and Conditions apply.
9.2 Any communication - electronic or physical from Air India is intended only for the person or entity to which it is addressed and may contain confidential and / or privileged information. If a Registered Customer has received such communication in error, please notify the sender immediately; in case of e-communications, please also delete the message from your system. Any unauthorized disclosure, copying, distribution or use of the message is strictly prohibited, and if done, will result in strict legal action. The message is not guaranteed to be complete or error free. No liability is assumed for any errors and / or omissions in the contents of this message. Reasonable precautions have been taken to ensure that the message is virus-free. However, Air India does not accept responsibility for any loss or damage arising from the use of this message or attachments. All the information contained here is correct and current at the time of publication and is subject to change without prior notice.
9.3 Registered Customers agree to defend, indemnify, and hold Air India and its affiliates and their directors, officers, employees, consultants, and agents harmless from and against any and all claims, actions, demands, liabilities, losses, damages, judgments, settlements, costs and expenses, including reasonable attorneys’ fees arising out of or in connection with the Programme.
10.1 All rights, titles, and interest in, and to the Programme, including all intellectual property rights arising out of or in connection with the Programme, including but not limited to “Air India” and all related marks, are owned by or otherwise licensed to Air India.
10.2 By enrolling for the Registered Customer Account, the Registered Customers waive all their rights and authorize and consent Air India to use their name and such details as may be required.
10.3 Air India may request Registered Customers to submit suggestions and other feedback, including bug reports, relating to the Programme from time to time (“Feedback”). Air India may freely use, copy, disclose, publish, display, distribute, and exploit the Feedback it receives from Registered Customers without any payment of royalty, acknowledgement, prior consent, or any other form of restriction arising out of your intellectual property rights. Registered Customers agree that while providing Air India with Feedback:
(i) the Feedback does not and shall not violate, infringe, or misappropriate any intellectual property right or other proprietary right including the right of publicity or privacy of any person or entity;
(ii) the Feedback does not and shall not contain any viruses, corrupted data, or other harmful, disruptive, or destructive files or content; or
(iii) the Feedback (A) does not belong to any other person to which Registered Customers do not have any right, (B) does not threaten the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, public order, cause incitement to the commission of any cognisable offence, prevents investigation of any offence, or is insulting another nation, (C) is not defamatory, grossly harmful, blasphemous, paedophilic, invasive of another’s privacy, discriminatory based on gender, ethnically objectionable, disparaging, relating to, or encouraging money laundering or gambling, libellous, hateful, racist, violent, obscene, pornographic, unlawful, harmful to children, or (D) otherwise offensive, objectionable, or restricts, or inhibits, any other person from enrolling for, using or enjoying the Programme.
